Terms of Use for Testers

Eligibility & payments

By applying to become a Tester with Userfeel, you agree with the following terms of use.

You are at least 18 years old. If you are younger, do not apply to become a Tester and do not take tests. If you are not at least 18 years old, we have the right to disregard your tests and deny payment.

Payments are made via PayPal. Any fees associated with your payment are deducted from the total amount of the payment. PayPal may deduct a fee from your payment.

In order to become a Tester, you must register on our site and provide personally identifiable information. This information will be used by our system to select the tests that fit your demographic characteristics, and will also enable us to contact you and send your payments. You agree to the collection and use of such personally identifiable information, including audio recordings of your voice as part of providing usability testing services. You represent and warrant that the information you provide to Userfeel will be authentic, accurate, complete and stated in accordance with Userfeel policies and procedures.

The qualification test, which is the first test that we may ask you to take, ensures that your equipment works properly and that you can provide valuable feedback. It is not payable. The qualification test content is property of Userfeel and may be used by Userfeel for promotional or other purposes.

Each test may last 1, 5, 20, 40 or 60 minutes.

You agree to be notified by email whenever there is a test available for you to take. You may disable email notifications on your profile page.

How testing works

We pay you to conduct tests on our clients' sites. In order to do that, you use our application, which records your screen and captures your face and voice through your camera and microphone while performing the required tasks on the site.

You are responsible for ensuring that audible and clear sound is captured by your microphone.

Using Virtual Private Networks (VPNs) or similar technologies to spoof or change your location or user information is against our policies and is strictly prohibited.

Userfeel makes no representation or warranty that you will be selected to perform usability testing services.

Conduct & confidentiality

You agree not to contact clients who have purchased usability testing services through Userfeel, or through information gained from our website, with the intent of offering your own services directly to the client as a substitute for our services.

You agree to full confidentiality regarding any elements you are testing, have tested, or will test, as a result of your participation as a tester for Userfeel, and you will not disclose to any third party any information relating to any usability testing performed for Userfeel, any information about any client or any element, and you may not copy or record any of the results of your usability testing.

You may not copy or take screenshots or videos of the elements, and you may not disclose this information to other testers or third parties, either in person, via the internet, or through any other form of communication.

You may not use any element after the usability testing services have been completed by you. If the usability testing services require you to download an element onto your computer, you will delete such element after completion of the usability testing services by you. If the usability testing services provide you with access to a password-protected website or a non-public website, you will not access such website after completion of the usability testing services by you.

Your personal information may be shared with a client as part of the usability test results. For example, your name, contact information, and video images or audio recordings may be shared with clients and their employees and agents.

Userfeel may extract anonymous statistics and otherwise aggregate non-personally identifiable information from the tests and reports you create, and feature such information on our site, and or disclose such information to third parties for marketing or other purposes.

Userfeel may post audio and video content that you provide while performing usability testing services on its website.

Quality review & payment decisions

Userfeel reserves the right in its sole discretion to deny payment to any tester for the following reasons: incorrect or misleading profile information, poor setup for purposes of conducting the usability test, duplicate accounts, substandard or incomplete testing as determined by Userfeel or its clients at their sole discretion, bad video, recording of the wrong screen, or usability testing conducted after the expiration of the testing period as set by Userfeel or its clients.

Userfeel will only pay you for complete, full reports and if the above guidelines have been met.

• Use accurate demographic and profile information.
• Record the correct screen with clear audio and speak your thoughts aloud during the full session.
• Complete every required task before submitting the report.

Liability, rights & legal terms

You agree that the compensation you receive for providing the usability testing services from Userfeel is complete and sufficient consideration for your providing the services and any information or suggestions you provide to Userfeel or a client therein. If and to the extent that you provide any suggestions, improvements, comments, requests for changes or any other ideas, recommendations or reports during your performance of usability testing services, hereinafter test results, with respect to any element or your performance as a tester, you hereby assign and agree to assign any and all rights in and to such test results to Userfeel.com for no additional consideration.

To the maximum extent permitted by applicable law, the website and content it contains are provided on an as is and as available basis without warranties of any kind. To the maximum extent permitted by applicable law, Userfeel disclaims all warranties, conditions, terms, representations and undertakings, express or implied, whether arising by law, custom, prior oral or written statements by Userfeel, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, satisfactory quality, non-infringement, and implied warranties arising from course of dealing or course of performance.

Userfeel does not warrant that the website or the server that makes it available will be free of viruses or other harmful components. You, and not Userfeel, assume the entire cost of all necessary servicing, repair or correction.

Userfeel makes no representations or warranties regarding the currency, correctness, completeness, reliability, suitability, availability, or operation of the website and the content, your use of the website and the content, or any third-party products and services you may obtain or any third-party website you may access through the website.

To the maximum extent permitted by applicable law, in no event will Userfeel, its employees, suppliers or licensors, or clients, their respective officers, directors, employees, agents, subsidiaries and affiliates and each of them be liable for any indirect, special, consequential, incidental, or punitive damages, lost profits, revenue, interest or business, whether foreseeable or unforeseeable, arising out of or related to your or any third party's claim regardless of legal theory, even if Userfeel.com has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, in no event will the aggregate liability which Userfeel, its employees, its suppliers and licensors, or clients, their respective officers, directors, employees, agents, subsidiaries and affiliates may incur for all damages, losses and causes of action exceed the amount actually paid to you for provision of the usability testing services at issue. This liability cap will apply only when and to the extent that applicable law requires liability despite the exclusion and limitation in the prior paragraph.

You agree to indemnify and hold harmless Userfeel, its employees, suppliers and licensors, and clients, their respective officers, directors, employees, agents, subsidiaries and affiliates, and each of them from any third-party claim, liability, loss, damage, cost or expense, including without limitation reasonable attorney's fees, arising out of or related to your provision of usability testing services, the website or any content it contains, your failure to comply with these terms, your infringement, violation, or misappropriation of any third party rights, or any violation of applicable laws or regulations.

Userfeel's clients for which you are providing usability testing services shall be considered third party beneficiaries of these terms to the extent that any act or omission by you causes any damage or liability to any such client, and such client shall have the right to enforce any provision of these terms.

You acknowledge, understand and agree that Userfeel does not have control over any element for which you provide usability testing services or to which the website may link. Userfeel will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, products or services available on such other websites or software or software prototype.

Userfeel reserves the right to discontinue the usability testing services at any time or otherwise make changes to the services at any time, without notice, and without liability to you or any third party of any kind.
